Terms of Service

1. Acceptance of Terms

By accessing or using MarkIT ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MarkIT is an offline-first attendance tracking Progressive Web Application (PWA) designed for teachers. The Service allows educators to mark, track, and export student attendance records.

3. Free Trial

New accounts receive a 30-day free trial with full access to all features. No credit card is required to start the trial.

• The trial begins on the date of account creation.
• At the end of the trial period, you may continue using the Service by completing the one-time payment.
• Your data is never deleted at trial end — it remains accessible even if you do not upgrade.

4. Payment Terms

After the free trial, continued use of the Service requires a one-time flat payment. Payment is processed manually:

• Payment is made via GCash to the account provided on the Pricing page.
• You must email a receipt to support@getmarkit.app along with your registered account email.
• Account activation occurs within 24 hours of receipt confirmation.
• This is a one-time payment — there are no recurring charges or subscriptions.
• Refunds are available within 7 days of activation. Contact support to request one.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

• Use the Service to store data about individuals without their consent.
• Attempt to reverse-engineer, decompile, or extract source code from the Service.
• Interfere with or disrupt the integrity of the Service or its data.
• Use automated scripts to access the Service in ways that exceed normal usage.

6. Data Ownership

You retain full ownership of all data you input into the Service, including student information and attendance records. We do not claim any rights to your data. See our Privacy Policy for details on how data is handled.

7. Data Storage

Attendance data is stored locally on your device using browser storage (IndexedDB) and synced to our servers when an internet connection is available. You are responsible for ensuring that collecting student data complies with applicable laws in your jurisdiction.

8. No Warranty

The Service is provided "as is" without warranty of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of bugs. Use the Service at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of data.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

11. Termination

You may stop using the Service at any time. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, you may request a copy of your data within 30 days.
